1. Summary Terms and Conditions for USA users

By downloading WIZ to your phone, you acknowledge that you agree to terms of service and as part of your registration process will be sent a registration SMS by Dynmark International Ltd. You will only be sent further SMS for this service if you re-register. You confirm that you hold the account corresponding to the mobile that you download to, or that you have the account holders permission to download WIZ to your phone. WIZ works with these carriers: Alltel, AT&T, Boost, Centennial, Cellular, Cincinnati Bell, Nextel, Sprint, T-Mobile, Unicel, U.S. Cellular, Virgin Mobile USA and Verizon Wireless but is only compatible with handsets using the Android operating system at present. Registration does not mean you will get any further texts after the text containing your Registration code. Message & Data Rates may Apply. For help, send "HELP" to 87790. Cancellation of WIZ is through the application. Text "STOP" to 87790 at anytime.

2. Terms of website use

These website terms of use (the Terms of Use) (together with the Privacy Policy, and EULA and any other documents referred to in it) tells you the terms of use on which you may use the website www.wiz.co (the Website), whether as a guest or a registered user. Please read these terms of use carefully before you start to use the Website. By using the Website, you indicate that you accept these terms of use and that you agree to abide by them.

4. Accessing the Website

4.1. Access to the Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Website without notice (see below). We will not be liable if for any reason the Website is unavailable at any time or for any period.

4.2. From time to time, we may restrict access to all or parts of the Website.

4.3. If you choose, or you are provided with, a username, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any username or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of the Terms of Use, Privacy Policy, EULA and/or any other relevant provisions.

5. Intellectual property rights

Should the Website prove defective, you assume the entire cost of all necessary servicing, repair or correction. The material displayed on the Website is provided without any guarantees, conditions or warranties as to its accuracy.

9. No Liability

9.1. The Website is provided to you free of charge. Accordingly, you acknowledge and agree that Dynmark, its suppliers, affiliates, directors, officers, employees and agents will have no liability in connection with or arising from your use of the Website as set out in this paragraph 8. Your only rights or remedy with respect to any problems or dissatisfaction with the Website is to immediately cease use.

9.2. In no event shall Dynmark have any liability for any losses or damages which may be suffered by you (or any person claiming under or through You), whether the same are suffered directly or indirectly or are immediate or consequential, and whether the same arise in contract, tort (including negligence), product liability or any other form of liability for: (i) any direct, indirect, incidental, special or consequential damages (including without limitation any loss or corruption to data, interruption, computer or device failure or pecuniary loss) arising out of the use of or inability to use the Website; (ii) any loss of income, business, business opportunity, profits, anticipated savings or goodwill (whether direct or indirect) arising out of the use of or inability to use of the Website, or (iii) any loss or damage which may be incurred by You as a result of any disruptions or delays in any communication when using the Website or the suspension or termination of this Agreement by You or Dynmark for any reason or the release or the decision not to release new versions of the Website to You.

9.3. The total liability of Dynmark, whether in contract, tort (including negligence) or otherwise and whether in connection with this Agreement or any collateral contract, shall in no circumstances exceed a sum equal to £50.00.

9.4. Some jurisdictions do not allow for the exclusion or limitation of liabilities as set out above. In such event the liability will be limited to the maximum extent possible within the applicable legislation.

10. Information about you and your visits to the Website

We process information about you in accordance with our Privacy Policy using the Website, you consent to such processing and you warrant that all data provided by you is accurate.

11. Viruses, hacking and other offences

11.1. You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website.
